Debt relief is something that millions of people need each year. For those who are looking for answers to their questions of just how to get out of debt, there is a lot of help out there. The question is, though, can they find a way to get out of debt in time? Many keep putting it off getting them farther into debt. When the only answer to debt relief is bankruptcy, people lose all hope. Before you get to that point, though, consider your options.

What Should A Lender LOI Include?

A Lender LOI or also a Letter of Interest is a document that a Commercial Mortgage Broker or Lender will provide to you when you submit a loan package. This document will state the terms of the proposed loan that the lender will give you.

The lenders LOI is based on the information you provide. So the more information you provide, the more accurate the loan quote will be. Too many times I’ve seen a lender quote a good rate with good terms, then turn around and not be able to provide those terms. Why? Because during the due diligence phase, the lender finds out the borrower did not provide accurate or all of the information. Remember, lenders are in a business and their business is based on known risk. A lender won’t be in business too long if they keep lending out bad loans!

So what kind of information should you expect to see in a Lender LOI?

Well, it should have the brokers or lenders name and contact information. Also the Lender LOI should include the following information.

Loan Name

This is usually the property name or address.

Loan amount

There is a requested loan amount and the loan amount the lender is going to lend. They will be listed on separate lines and the numbers may be different.

Quotation date & expiration date

The lender will only give you a specified amount of time to review their loan quote.

Loan terms

This is usually listed in years or months.

Amortization

This is usually listed in years or months.

Interest Rate Spread

This is a percentage over the current index yield.

Current Index Yield

The index yield on a given day.

Final Note Rate

This is the interest rate you will pay. It is the interest rate spread plus the current index yield.

Interest Rate Index

This is the index that is used in determining the current index yield. Examples are 10 yr Treasury, Prime or LIBOR.

Loan Type

This is stated as either fixed or variable loan.

Interest Accrual Method

This is how the lender will calculate your amount of interest.

Proposed DSCR

This is debt service coverage ratio for your loan amount.

Proposed LTV

This is the loan to value that the lender is willing to loan to you. This determines how much money you need to put down.

Prepayment

For paying off your loan early, some lenders charge a fee or penalty. That should be outlined in the lender’s quote.

Recourse Options

The loan will either be full recourse, partial recourse or non-recourse. Recourse determines if you are personally liable for any loan default.

Assumption & Assumption Fee

With most commercial loans, the loans are assumable for a new borrower for a small fee.

Junior Debt

Whether the lender will allow a 2nd to be taken on the property.

The lender will also state what conditions must be met for the loan. Examples are clear title reports, inspection, occupancy, etc. Also, the lender will give an estimate of the fees (due on acceptance of loan and at closing).

Dealing with Finances After the Marriage

After the wedding I thought transitioning into married life was the hardest thing I would ever have to do in my personal life. I had never lived with a man before and nothing could have prepared me for the treatment I would succumb to over the next 12 years. I endured an array of verbal abuse ranging from the color of my hair (which was the same since the day he married me) to my apparent lack of intelligence. The degree of physical abuse was minimal but unforgivable and strangely he was most hurtful when he was sober, because then I knew he was aware of what he was saying and really meant it; though the details of the marriage don’t really matter.

What I was even more unprepared for was the divorce. It was a long time coming and beforehand I told myself I would take it in stride and never let myself miss him. To my surprise I had no problems holding up that promise to myself and early on found that I quite liked the fact that I could do whatever I wanted for dinner without being ridiculed about my culinary skills, or wear whatever my heart desired without being called “tramp-y” for showing some leg. And who would imagine that I, the one who has the intellect of “a can of soup”, could get a decent job?! I don’t think anyone would disagree that it’s pretty easy to adjust to living in a peaceful home after years of walking on eggshells.

So what was I so “unprepared” for? Where’s the tragedy to the story? Upon the finalization of my divorce my battle became a financial one and as many of us know that can rapidly turn into an emotional battle as well. Though while we were together money was never brought to my attention as a problem I soon found all the secrets he was keeping from me. Its not that he ever even lied to me about money, he just kept it all in the closet. I discovered a huge outstanding balance on a loan he told me had been paid off years before and had since been unpaid between the time he moved out and the divorce finalization (about two months).

It got a little more serious after they repossessed the car he had bought me (also supposedly paid off) and of course, it was under my name. Though I tried to remain as apathetic towards him as possible every time I found another credit card bill he was sticking me with I wanted to dislodge his tonsils with a spoon and yell at him “How could YOU be so stupid? How could you not have told me we were in such bad debt, especially after all those times I told you I wanted to get job and could have saved us this heartache?” That was what I was most in awe of, his deception. Of course hindsight is 20/20 so no wonder he never let me help out by paying the bills or have access to his accounts.

Long story short, I was eventually forced to move from my home (yes, the one I had planned to retire in someday) and I now live in a modest apartment with my niece- though at times I’m sure she wishes her roommate was a little more hip. It’s been a long road to recovery and there’s still plenty of road ahead but I’m making headway. I know this story has been retold in too many different renditions to count but I would like to offer my two cents to anyone out there who is on the brink, anyone who finds themselves at the intersection of desperation and alone, there is always someone you can talk to.

To be honest, for me friends and family weren’t exactly the ones I wanted seeing me in my fits of rage. I didn’t just want to talk to someone who cared, or who would “help me get through it all”. I wanted someone with the real life experience, who had been down where I was at that moment and could talk me off the ledge because they knew exactly how I felt. And I do believe that permitting myself to let strangers see me like that allowed me to carry on a more normal day to day life without hurting my loved ones.

The irony of all it all that I realized only a few years ago: if we hadn’t been so in debt, or if he had at least told me and allowed me to help him, would we ever even have split up? Was his anger toward me a repercussion of his worry about finances? I haven’t spoken to him in years so I don’t suppose I’ll ever have the chance to ask but now all I can do is encourage all those out there who may be finding themselves between a particular rock and an all too familiar hard spot there are people you can talk to. If not I would still recommend you to find someone you can vent to, they say keeping a journal of your feelings is great therapy but a journal can’t offer advice and the occasional response. Danger: Scam Zone

The days of being safe on the internet has never existed. What’s worse is the fact that through all the safety precautions that you do take, you still can get caught up in a scam. It’s also been said that the internet is less safe now than it was a year ago.

You average person on the internet may be honest to a certain extent. The problem is the excitement of quick riches. Some of the more experienced marketers, shoppers, or computer gurus may be able to detect some dangers. Not all dangers can be eliminated.

If you haven’t been stung, you will be. It’s not a question of if, but when. The severity of that sting is what’s most important.

It should be the duty of every internet shopper, guru, and marketer to report scams, phishing, chain letters, and ponzi schemes.

I’ve personally witnessed people clicking on email links because of a warning. I see pop-ups come up all the time with warnings that are not part of your computer just so that it’ll go to the persons’ email address that made this pop-up.

If you click on a pop-up, you must be made aware that some people claim that to be a permission to email you. You may not even be aware of it.

I’ve spoke to several clients of mine about the dangers of the internet. Their response was: “I have a virus protector.”

Having a virus protector, a spam blocker, a pop-up blocker, and every piece of software on the market will not save you from your own enthusiastic approach to getting rich if you believe it takes no work. Now that was a long sentence. Sorry.

I’ve been on the internet since 1994 and have spent countless thousands of dollars finding scams, making mistakes, and still get scammed here and there.

Have you heard of people filling out surveys? It is my opinion that if you participate in some of these surveys, you will give the provider all the information necessary for them to steel your identity. Now bare in mind, I know some people that are making money filling out surveys. I’ve even been told that “survey scout” is the most respected of all survey opportunities. However, they just lead you to the data base or surveys.

Here is something you should think about. How many people do you know that has your name? Now, how many people were born on the same day as you with that name? With these two pieces of information, and the technology we have today, I’d be very reluctant to giving my birth date out.

To take this another step: What do you think could happen if you type your information into a survey that asks for your name, birthday, home address, how many people live with you, the ages of your children, and even your social security number.

You’ve just opened up the door for that information not only being available to everyone with cash but also to a scammer.

You see, the dangers of the world may not be guns anymore. It may be our own self destruction.

The information highway may be the most dangerous tool around if used improperly. Again, the most honest people around unknowing participate in scams, ponzi schemes, and chain letters hoping to gain riches.

I’ve even found more scams than I can count in my marketing target. I love health benefits, weight loss, and fitness. Now in reality, you should not fall for anything that promises you that weight loss can be achieved by eating anything you want without one small calculation. Calories in minus calories out determines your weight.

Of course I could be wrong. I still believe in what I’ve sold.

RAID Disk Recovery

RAID is short for Redundant Array of Independent (or Inexpensive) Disks, a category of disk drives that employ two or more drives in combination for fault tolerance and performance. RAID disk drives are used frequently on servers and increasingly being employed on personal computers. Array is the operative word, which also dictates what the cure is going to be, when a RAID disk recovery situation arises.

RAID disk repair, as you may expect is quite a complicated process. But the good thing going for it is the chances for retrieving lost data is higher than with most other types of disks because the typical RAID architecture strategically distributes data randomly across the array. What this sort of architecture demands of recovery professionals is to specialize in the disk’s many different levels.

In a nutshell, these are all the levels that the RAID disk recovery team is up against. RAID 0, 1, 0+1; RAID 3, 4; RAID 5; RAID 10; Hardware RAID including: AMI, Compaq, Dell, Adaptec, IBM, etc.; and, Software RAID including Mac OS; Windows Servers including 2K, XP, NT; Linux, Solaris, Novell, etc.

10 Tips For Raising Your Search Engine Rankings

Search engine rankings are an important factor to consider when
you have a website that needs more traffic. If your website
doesn’t have a good position in the rankings then no-one will
find it, so you need to make sure that your website is ranked
highly enough to be seen. The other important quality to getting
high traffic to your site is having a nice arsenal of links. The
more links that you have to your site the more traffic you will
get, but also, the more links to your site the more search
engines like your site. Keeping a nice supply of links pointing
at your site requires similar precautions and practices as
getting high search engine listings.

Although no SEO company can guarantee a high ranking for your
site, here are some tips for raising your search engine ranking.
Using these tips will not get you to the top unless your site is
the best out there, but they will at least put you into the
positioning that you truly deserve. After all, the internet is
basically a free market. You will naturally flow into the place
that you deserve and many search engines try to insure that you
do not rise above or fall below this position. This is why they

5) The navigation menu that appears on each page of your website
should include your page’s title.

6) Don’t just use the most popular keyword phrases - the market
is so competitive that you should be sure to include some niche
keywords too.

7) Make sure that you don’t have a lot of irrelevant links on
your site. The more closely related to your site your links are,
the better your chances of being ranked in a higher position.
8) You need to periodically update the content of your website,
even if it’s only a slight change, as websites like sites that
are kept updated.

9) You need to consider the fact most search engines don’t like
automatic submissions or multiple submissions - submit once,
manually.

Barbara Willis, a Glen Luken’s Protege is Rediscovered

Barbara Willis was born in Bakersfield, California on June 29, 1917. She began her art career by studying with potter Laura Andreson and trained with the master, Glen Lukens at UCLA in the late 1930’s. In 1942, Barbara opened her first studio pottery. With the shortage of domestic products due to World War II, Barbara then went from studio to production potter. Barbara’s unique glazing technique, vibrant colors and imitation wood designs were sought after by the large store chains such as Neiman Marcus, Lord & Taylor of New York, Gump’s, & Macy’s to name a few….including the White House. The popularity of her work lasted until the mid 1950’s when art pottery interest declined due to the increase in imports after the war. Barbara closed her pottery and moved on to her next business venture.

In 1994, Barbara Willis found a piece of her vintage pottery at a flea market. During a conversation with the seller, she passed on her phone number. A few weeks later, an avid collector of her vintage works called her to explain that she is a California Art Pottery legend! Barbara was encouraged to begin a new line of pottery and, this Barbara Willis, Terrene Pottery was reborn! Barbara utilizes a different approach in the making of her contemporary line. She hand presses each piece, using one of three types of clay. Barbara uses a unique one-fire glazing process. Each piece is definitely one of a kind!

What a gracious woman! I had the opportunity to meet Barbara Willis, in person, at the Los Angeles Pottery Show on January 29, 2005. In anticipation of meeting and talking with her, I took along my book “Barbara Willis - Classic California Modernism, by Jack Chipman” and asked her if she would be kind enough to sign it for me. She signed it “To Alice, Warm Regards - Barbara Willis - 1/29/04.” I later noticed that she had inadvertently dated it 2004 instead of 2005. Like most of us, we write the previous year’s date until we are used to the new year. I certainly did not mind the incorrect date. I was overjoyed that I was conversing with her and expressing my admiration for her work directly in person.

I speak of Barbara Willis with much enthusiasm because of many reasons. First and foremost, I love her pottery - not only her vintage work, but her contemporary work as well. Here’s a woman, in her late 80’s, who currently has her “creative juices” in motion, working right out of her home in Malibu Beach letting herself be known again to the pottery world after a thirty-seven year absence to clay. I, like many others, am very appreciative of her work and share in the joy of her return as she quickly is being recognized as an important American ceramist!

For Seven Days I Thought I Was Dying

So here’s the story… I moved to Stroudsburg, PA this past July to become Rabbi at Temple Israel of the Poconos. As part of the move, I needed to find new doctors who would look after me. I made an appointment with one of the local specialists, who suggested that I should have my lungs checked as part of a thorough physical examination. So he scheduled me for a C.A.T. scan, expecting to find nothing out of the ordinary. Well, surprise, surprise! When I returned to the doctor for the results, he told me that there was a spot on my lungs, and he could not rule out lung cancer!

Next he scheduled me three days later for a P.E.T. scan, which would definitely show if anything was going on in my throat. I came to the surgery center and they inserted some dye through an IV, which would flow through my entire upper body, and by means of the the scan, would clearly allow the radiologists to diagnose any real or potential problems. So I lay still for sixty-five minutes, trying to “zone out,” actually counting the seconds (one thousand one, one thousand two, one thousand three…) and pretty much trying to act like the macho man that I did not feel like. My doctor had scheduled the next appointment for a week later. I asked him for an earlier date, but he said it took that long for the results and the evaluation of the scan. Actually, that was all done two hours after the test, but who knew?

I had a whole week to think about dying of lung cancer. What made it really scary was–my Mother died of lung cancer. She was a heavy smoker, I have never smoked, but I had already presumed that it was genetic and that my life was over. And then I began to plan. What would I do with the time I had left? First, would I take chemo and radiation for the cancer? I decided absolutely not, since I was not prepared to spend the next year suffering through mind-and-body-numbing treatments which would at best give me another month or two of life which was not-life. I have seen too many of my congregants and friends go through that, it was not for me. Would I quit my job as Rabbi? Yes, I would have done that immediately, and I even began working on my final sermon. I would have told my new congregation that there were places in this world that I wanted to visit with Ellen, and that I especially needed to return to Israel for a final visit, so I was resigning from the pulpit, to live out the rest of my life the way I wanted to. I would thank them for the lessons they have already taught me even in the short time we had together, and I would ask their forgiveness for any pain I had caused them. In short, I would complete my relationship with them before I left.

After seeing other parts of the world, I would return home and begin to travel all across the country, giving a lecture to anyone who might be interested, entitled: “Final Life-Thoughts of a Grateful Rabbi.” The lecture would talk about gratitude being my first-choice feeling on learning of my impending death. Above all, I am grateful for the life that I had been granted; I considered my life a precious gift to me from God. After gratitude comes everything else, all other feelings and thoughts. The world can only be repaired when gratitude replaces entitlement, when we move outside of ourselves toward others in our lives. I was not angry, just sad that I would not live to see my kids’ life-cyle events or share in the lives of my grandchildren as I had hoped to be able to do. My hopes, dreams and aspirations have been reached, I would die fulfilled and happy. If my time had come, I would be ready, unafraid and unashamed of what I had accomplished in my life. I know that I have mattered to lots of folks, and my teachings and my memories would be my final gift to them, and to the Universe.

I fully believe that when our mission on this earth is accomplished, we can then be ready and prepared to leave this world for whatever comes next. The problem is–who among us knows when that will happen? How will we know when our life-missions will have been accomplished? We don’t, so that when God has decided that my earthly purpose has been fulfilled, who am I to argue? Even more, I have known too many women and men who have lived “too long,” that is to say that their final years were spent in pain or in a nursing home, or totally unable to communicate with those they love. I would indeed be fortunate, because I would leave this life on my own terms, proud and grateful. And not in any physical pain.

So you see, smart guy that I am, I was sure I had it all figured out. Needless to say, thank God, the results came back showing that the spot on my lungs was just that, some benign scar tissue left over from who-knows-when. I was elated. I really was! But to tell the deep, dark, dirty, honest-to-God truth, I was just a wee bit disappointed at the same time. I was actually looking forward to the last year of my life, I was going to be able to fill the closing chapter of my existence with passion! Between seeing the world, teaching women and men all across America the truths I had learned, finishing my book on grief and hope, perhaps starting another book, my days would be filled with joy and creativity. They would be filled with life, not death, and when the end would come, I would feel that the banquet of my life had been well worth my fifty-nine years of effort.

That’s my story, and it has a happy ending. Sort of. The gnawing-in-my-kishkas question I continue to ask myself ever since this happened is: What’s stopping me from doing all those things I was going to do when I knew I was dying? How many of them can I still do right now, while I am still living? Why will I have to wait until the Angel of Death comes calling for me, for real? It is these questions, not thoughts of my death, which continue to haunt me. Maybe soon I’ll have some good answers.
