The more painful the injury, the longer the recovery period, the more obvious the medical evidence of the injury, the more invasive and long-lasting the medical treatment, and the more serious and visible any permanent result of the injury, the higher the multiplier is, too. Also, the more of your treatment you receive from a physician or at a hospital, or opposed to physical therapy, chiropractic and other non-MD treatment, a higher multiplier is also used.

Once you know how insurance companies use the damages formula to start negotiating, you are close to figuring out the total value of your claim. The extent each person is at fault is the most important factor affecting how much the insurance company is likely to pay. The damages formula gives you a range of how much your injuries might be worth, but only after you figure in the question of fault do you know the actual compensation value of your claim — that is, how much an insurance company will pay you.

When you already know how insurance companies utilize the damages formula to begin negotiations, you are near at finding out the exact and total value of your claim. The degree that every person is being held liable is the most significant element that affects the amount that the insurance company is most likely to pay an accident’s victim. The said formula for damages provides you with the range of how much your injury might be worth but only after you figure in the question of fault do you know the actual compensation value of your claim - to be exact, how much an insurance company will compensate you.

The definition of success may be different for every person, but
when getting to grips with the term, essentially it is about who
you are, and who you are becoming. It is about living up to your
potential and achieving your dreams. Your success is what will
bring you a life of contentment, pride and enthusiasm in your
accomplishments.

Too often than not though, we make lists of goals we want to
achieve, but the list remains on the nightstand or kitchen
table. The words do not move from the page and success seems to
elude us. Regardless of what success means to you, there are
strategies for making it all happen and come true for you. It is
not as difficult as it may seem and is not only meant for
certain people.

Are there goals you want to reach in your host country? Are
there dreams you want to see happen before repatriation? I have
spoken to expatriates who had such high hopes of using their
years abroad to their fullest potential, but leave the borders
feeling deflated and wishing they had used their time more
successfully. If this is you right now, you can still make it
all happen for you by applying some easy strategies that work if
followed consistently and with enthusiasm.

Take action and move. Move both physically and spiritually. It
could be as easy as buying a book you have been wanting to read,
but get off the couch and move. If you don’t move you fall
behind and then it takes double the amount of effort to play
“catch up”. In other words - actively pursue your dreams and get
into action. Write down your goals. Be as literary as you need
to be and put pen to paper writing down in detail exactly what
it is you want to achieve and what kind of life you want to
live. To ensure that you do not set yourself up for failure,
make the goals specific, measurable and hold yourself
accountable. You do not have to do this alone, ask a friend,
spouse or colleague to help you be accountable if need be and if

and support from others and be creative. Be careful not to shut
yourself off to new ideas, new thinking, new challenges and new
experiences. One never knows what opportunities may be waiting
behind closed doors. Embrace all the “luck” that comes your way
once you get into action. It is true that that Life rewards
effort exponentially, no matter how small the effort or how
challenging the obstacles. So, do not be afraid to visualize
your highest goals and stay on a path of action to achieve them.

Set goals that are yours and not someone else’s dream for you.
It may sound selfish, but it is essential to you following
through. Before setting your goals, take time to look at your
thoughts and beliefs. Self-awareness is the key to making the
best choices.

Some key areas in which you might consider writing your goals,
if you have not already, include: family, spirituality, career,
interests, lifestyle, financial, self-growth, health and
well-being.

Give a plus to each of these areas you are happy with and a
minus to each of the areas you are unhappy with at this present
time. Choose one of the minus areas you are most unhappy with
and make your beginning here. This is your first step to a
happier and more successful YOU.

Trademark Your Business – Lessons Learned

Small business owners learn many lessons the hard way - through
the school of hard knocks. I recently experienced my own tough
lesson concerning the importance trademarking my business name.
Like many solo-entrepreneurs on a tight budget, the thought of
trademarking my business name was not high on my priority list.
Had I placed more importance on it, I might have saved myself
some anxious moments, not to mention a few hundred dollars in
attorney fees!

As a member of a couple different virtual assistant membership
organizations, I often look with interest at other VA’s business
names and website URL’s. One day I noticed a new member
announcement for one of the groups and saw a listing for VA
Office Solutions. Now this one hit a little too close to home for me - after all, my business name is VA Office Solution. I also noticed that she had a domain name to match.

Have you figured out my first mistake yet? I could have kicked
myself for not purchasing the domain name,
http://www.vaofficesolutions.com, which is so close to my own
domain name of www.vaofficesolution.com. After all, even some of
my own clients inadvertently add an “s” to the end of my business name in correspondence. I certainly didn’t want people to look for my business on the Internet, and mistakenly find this other website! This could potentially be very confusing for both of us, especially considering we both operate similar businesses and conduct our business virtually, working with people all over the country.

Well the first thing I did was a little research on this domain
name. I was able to find the owner and saw that the name had only recently been purchased, and had only been purchased for a one year period. This indicated to me that this was a new business, and she had only just started using this name.

Then next step was to get some legal advice. I had met an
attorney who specializes in trademark law at a networking event
so I gave her a call and asked to meet with her. I learned that I definitely had a good case, as I’d been using the trademark since 2001. Even though I had not formally registered the trademark with the USPTO (U.S. Patent and Trademark Office), I still had first use of the trademark, which gives me certain rights.

After meeting with the attorney, I decided that my first step
should be filing my trademark with the USPTO (http://www.uspto.gov). Now this is something that I could do
myself, without paying an attorney, but taking into consideration my own time constraints and her expertise, I decided to let her handle it for me. Also, since there would need to be a letter drafted to the trademark infringer after my trademark had been filed, I just felt more comfortable letting my attorney draft a letter that would be effective enough to get the infringer to stop using the trademark and take the website down.

So how did it all end? Well I got my trademark registered and we
sent the letter to the trademark infringer. She agreed to stop
using the trademark and took the website down. All in all, the
entire process took about three months. I feel very lucky though, as I was able to find this infringer very soon after she opened her doors for business. By getting it done quickly, it should not have been devastating to her business and did not have an apparent affect on my business.

So what should you consider when deciding if you should trademark your business name? First you should conduct some research to make sure you’re not infringing on someone else’s trademark. You may be forced to stop using it if that’s the case. If you decide to trademark your business name, then you must be prepared to enforce your mark. If you allow others to use the mark, then you can face abandonment and risk losing your own trademark. You should also consider the domain name issue. Do not make the mistake I did and let someone else snatch up a domain name that matches your trademark.

Start Trading: Throw Those Excuses Out the Window

People make all kinds of excuses as to why they cannot get involved in investing
or trading the financial markets. In this article, some of the most prominent are debunked.

“I don’t have time”
Despite being one of the most frequently heard, this is probably the most
pathetic excuse for not trading there is. Why? Because the availability of
technology and information in the modern day means that we can operate in
literally any time frame we want. Many people, when they hear “trading”, think
it means sitting in front of the computer all day. While that certainly is one
form of trading, most of us do not have the schedule to allow us to dedicate
hours each day to monitoring the markets. The good news is that we don’t have to
in order to trade effectively.

I will use myself as an example. My college coaching position has me frequently
in the gym, in meetings, and on the road. What’s more, I run a club program and
a couple of businesses on the side. In 2004, even though there were long periods
when I did not trade at all, and I probably only put on a dozen total positions
all year, I was still able to make 200%+ in the stock market. If I can trade
given my schedule, and have performance like that, anyone can.

“I don’t have the money”
In the past, this was a pretty viable excuse for not trading. These days,
though, one can trade with relatively little money. Transaction costs have
dropped dramatically over the last decade and there are more trading options
than ever before. There is one particular trading platform which allows an
individual to put on trades of at little as $1 in value, and they have no
minimum account size requirement.

Is it better to have more money? Absolutely. The more capital you have at your
disposal, the better are your available options and the more actual money you
can make in raw dollar terms.

Having more money is not always a good thing, though. For the inexperienced
trader, it is better to have only a little money at risk. Why? It is the same as
anything else. Just like anyone new to a skill make mistakes as they are
learning, so do new traders. And just as a coach would not willingly throw a new
player in to a championship game against experienced opponents, neither should
those new to the markets to take on large trades and put significant portions of
their assets at risk. It’s common sense. Better to make the inevitable mistakes
when there is relatively little at risk.

“It’s too risky”
Trading is only as risky as you make it. If you take risky trades, then trading
is risky. If you don’t, then it isn’t. There will always be the risk of losing
money on a trade. That is completely unavoidable. But that could be said about
all of life.

Driving is one of the most risky things in the modern world, but we still do it.
We reduce the risk by obeying traffic rules, planning our route, wearing
seatbelts, paying attention, and all that. Does that completely eliminate the
risk that of ending up in an accident? No, it doesn’t. Nor does it necessarily
keep us out of traffic jams or from getting lost. We understand the risks,
though, and weigh them against our need to get places in a timely fashion.

Trading is the same. We do it because it helps get us where we want to go, in
this case financially. There are going to be hiccups along the way, but if we
are focused and conscientious, we can minimize the risks, and potentially the
damage an unfortunately turn inflicts, and remain on course.

“It’s too complicated”
Technology and competition have combined to make trading so much easier than it
has ever been before. All it takes is a couple of clicks and you can execute a
trade, check your positions, get news, and anything else you need to do.
The fact that you are reading this article says you have all the basic skills
necessary to trade or invest.

Can trading be complex? Sure it can. There are those in the markets who use
complicated software, mathematical algorithms, even artificial intelligence.
None of that is necessary, though. Some of the best traders use little more than
price quotes or a simple bar chart. How intricate you get is strictly a matter
of personal preference, not necessity.

Is there a learning curve? You bet. Trading is like anything else. There are
things you need to know. The good thing, though, is that there are loads of
resources out there to help you learn.

Camera RAW part of Photoshop 7 Adobe Photoshop Camera RAW & JPEG 2000 Plug-in Bundle is now an integrated part of Photoshop CS. This has added substantial power to Photoshop CS. JPEG 2000 delivers superior quality for the same compression ratios. Conversely, since no camera support JPEG 2000, support is available through a separate plug-in that ships with the software.

Depending on the camera brand, Raw may come in different flavors. Adobe Photoshop CS covers most RAW formats available today. However, RAW data may not be always read accurately. For example, the white balance of Nikon Coolpix 5000 images may have unnatural result which is not a case with Nikon Capture 3.5. To fix the white balance, click in a non-specular white area followed by a minor tint adjustment. Supplementary adjustments can be made through the advanced “Calibration” tab. The “Adjust” tab controls exposure, shadow, brightness and contrast sliders. Albeit Photoshop CS features now a new Histogram Palette, the RAW dialog box also features live histograms.

Noise reduction is not a problem with Photoshop CS. It has the color noise reduction and luminance smoothing sliders which allow you to reduce colors and luminance noise. Luminance noise should be use with caution because it can lead to an artificial “water paint” effect. The noise reduction performs very well and preserves the image detail and sharpness.

To remove chromatic aberrations, apply a local desaturation in the corresponding color channels. The Lens tab of the Raw dialog box provides effective ways of eliminating these aberrations.

Which Spam Filter Is Best For You?

With the number of spam filtering solutions increasing each week it’s getting tougher for consumers to make informed choices in their purchases.

There are 3 basic types of spam filters:

  1. Integrated

  2. Standalone

  3. Online

We’ll look at each type of spam filter and at the end you should be able to decide what spam filter is right for you.

Integrated spam filters

This type of spam filtering software is the most common. Once installed it sits “on top” of your existing email software and installs a new set of buttons into your email software. In future when you collect email you’ll see options for marking email as Spam, marking the email as Not Spam, Bounce the email back to sender, etc. The description and position of these buttons varies from one product to the next but their purpose remains the same.

Standalone spam filters

These are less common than their integarted counterparts but that doesn’t make them any less useful. A standalone spam filter is basically a separate piece of software installed on your PC that you use to check your email for spam.

Standalone filters have the big advantage of being able to preview your email on the mail server before it’s downloaded to your PC. This one single feature has the huge benefit of allowing you to just download the email that you want as opposed to downloading all of your email, including the spam, and then sorting through it.

Using a standalone spam filter is a little more work simply because it’s a separate piece of software that you have to run before you open up your email software. Most standalone filters do allow you to configure them so that your standard email application is opened once you’ve chosen what spam to filter. This suits some people and not others.

Online spam filters

There are really two types of online spam filters. One is for business use and one is for home use. A typical example of a business type product is iHate Spam server edition where the software deletes junk email directly from the mail server before the end user even sees it. Large companies employ this type of technology.

Home users will be using Spam Arrest or similar. Spam Arrest offers an inventive solution to spam whereby any email sent to the users account has a challenge request sent back to it which the sender must authenticate. The automatic junk email software used by spammers can’t currently deal with this type of response. Any failure to authenticate the challenge email results in the junk email being left to die in cyberspace. A user is authenticated with Spam Arrest only once for security just to make sure the software doesn’t become a nuisance.

The Jewelry Hut Artice 4: How to Buy Jewelry, Setting and Clasps

In buying any jewelry, one should look at more than the quality marking. Sometimes what you want to look for depends on the type of jewelry. Here are buying jewelry quality marking general guidelines:

Be satisfied that the metal is what it is supposed to be.
Inspect the claps and settings, if gems are involved.
Check any and all links carefully, regardless of the type of jewelry. Any chain is only as strong as its weakest link, and any jewelry is only as strong as its weakest link. The links may be an integral part of the jewelry or they may be used to connect the jewelry to the clasp or catch. The links should be well made, with no separation where the link is joined to form a circle. A link that is bent or is slightly apart may give way under wear, letting the rest of the jewelry or part of it slip through.

Keep in mind the intrinsic qualities of the metals, too. Platinum and silver are harder than gold, which is relatively soft in is purest forms. The purest the gold, the softer it will be and the more apt it is to wear thin or lose its shape with wear.

1) Rings.

Regardless of the kind of setting, check the stone and make sure it is held firmly in the setting, whether the setting is open or closed.
In an open setting such as high or Tiffany setting and the low or belcher setting, examine the prongs. They should grip the gem at the girdle, closing firmly just above it. The prongs should be smooth. Remember, the higher the setting, the more stone will be visible, with a greater tendency for prongs to catch on gloves or clothing. You want to be sure the prongs are made in such a way that there are no rough edges that could catch or that could lead to the prongs being bent or broken an d the loss of a stone.

In a closed setting, examine the rim or bezel that holds the gem. Some gems or coins may be set just below the rim and may have prongs at the back holding them against the rim. In this case, make sure the prongs are tight and well made to hold the coin or other material in place. As far as gold coins go, make sure the coins are mint perfect, not bent or scratched or damaged by the setting.

Cabochons are usually set in a closed setting, with the dome higher than the setting. Again, the setting should be made in such a way that the gem cannot fall out. This is particularly true if the gem has a tendency to contract or expand. A gem may feel very slightly loose, but by trying to move it you should be able to feel the firmness of the setting.

The fit of the ring is as important as a well-made setting. A too loose ring may fall of your finger, while a snug on may be difficult to get on and off. Making sure the ring fits in a store is not enough. You want to take into account whether your fingers have a tendency to swell in warm weather or not. If they do swell, you may want to consider a slightly large ring on which you can have a ring guard put.

A ring guard can be preferable, especially for rings with narrow backs. A wide ring is more difficult to fit with a guard, but it is also less apt to slip off or slip around your finger. If you do decide to have a ring made smaller, remember you are losing precious metal. At the same time, more precious metal will be needed to make the ring larger.

2) Earrings.

The choice of earring backs is strictly personal. Earring with screw backs should be checked care fully to make sure the screws are in good working order and are tight enough for you to fasten securely in or on your ears. Clamps should be tight, although not so tight that they are uncomfortable to wear. Comfort and a secure fastener, in fact, are probably more important for earrings than other jewelry, since there is no way you can add a guard or safety catch as you can for other jewelry. All you can do is make sure the backs are good ones and they work well—and that means on both earrings.

Try putting both earrings on and taking them off several times. To put them on correctly, pull lobe down, place earring, and adjust back. When you have them on, shake your head vigorously to make sure the earrings don’t loosen or fall off. Shaking your head will also assure you of another factor: are they so heavy that they bother you or so light that you can’t feel them and could lose one just by using the telephone?
A store may sometimes not allow you to try on earrings, in which case you should ask to see the manager or go to another store. In case you are purchasing an earring from online store, most online stores have return policy. You need to try earrings on to judge whether the design and color flatters you because they are so close to your face. Then, there are size and weight. Not all earlobes are the same. Earrings that may fit one ear may be too large or heavy for other earlobes. Most necklaces and bracelets will fit anyone, but not most earrings. In short, when buying expensive earrings in particular, you need to try them on before deciding you like them and can wear them.

3) Clasps and Catches.

All clasps and catches, both regular and safety ones, should be worked several times, on you and off you. Do they fasten easily and firmly? Can you work them yourself without help? Make sure you try the jewelry on yourself as well as letting the clerk help you. If you find that you can’t put the jewelry on by yourself, it may be a bad buy—regardless of cost—unless you always have someone available to help you.
